In short, your spouse cannot quit working to avoid paying alimony. The court is not likely to accept that. Instead, if handled properly by your attorney, the court can impute income to the spouse.
You will need to bring records to prove how much the spouse was making consistently, and you can also bring in a vocational expert. A vocational expert is an expert in employment, and they can tell the court that your spouse is capable of making a certain amount but is choosing not to work. Or, the court may find that the spouse is choosing not to work.
Even if not working, the spouse can be forced to pay alimony while treated as if making the income level earned before quitting work. In addition to being out of work and having to pay the alimony, the spouse's credibility is also tarnished in front of the court, and this can affect other facets of the case in your favor.
