If you have a lot of money and assets and you are getting married, you will likely want to create a prenuptial agreement to protect your family's money and estate. The most important thing when doing this the right way is to make sure you give a full and complete disclosure. You must be very thorough because not disclosing something can create trouble for the agreement.
It is also a very good idea to make sure your spouse meets with an attorney. They do not have to spend a lot of money or hours with the attorney, but it is important that they review the document with their attorney so they do not come back later and say they never met with an attorney, that they were only advised by your attorney, or that they signed the document under duress.
It also must be very clear that the process is done fairly. If it looks like it is totally unfair, that is called being unconscionable. We don't want it to look too lopsided. Or, if it is lopsided, we must make sure it is extremely clear. Therefore, you do not want a boilerplate prenuptial agreement. We need to draft it the right way and make it very customized and specific to your situation and assets.
