http://www.TerryBryant.com. That's a question I've heard many times over the years in representing people injured in car wrecks and the answer is basically yes, a qualified yes that is. Your car payment is a matter of a contract between you and the bank or credit union or car manufacturer and whether your car works properly or doesn't work properly, you still owe your monthly payment. Now when your car is totaled in a wreck that's caused by someone else's negligence, that other person or his or her insurance company is responsible for paying for the damage to the vehicle. Typically, what we do is get the property damage portion of the claim resolved fairly quickly, almost always before the next car payment is due and that way the car payment doesn't need to be made because the vehicle is paid off. But if that's not the situation, if you don't have an attorney or you're handling a case on your own and you're not able to get the property damage resolved before your car payment is due, yes you have to make that car payment.
