Ensuring the highest attainable standard of health for children deprived of their liberty

Health Law and Ethics Network at Melbourne Law School hosted their Monthly Lunchtime seminar on Tuesday 16 April 2024. This seminar was presented by Professor Stuart Kinner, Curtin University and Senior Associate Tess Kelly, Correctional Association of New York (CANY) on 'Ensuring the highest attainable standard of health for children deprived of their liberty'.

Children who experience deprivation of liberty are distinguished by a high prevalence of complex, co-occurring health needs that necessitate coordinated, high-quality healthcare. Evidence of very poor health outcomes after deprivation of liberty suggests that in addition to ongoing efforts to prevent detention, more should be done to improve the health of these children, both in detention and after they return to the community.

In this presentation we critique current standards for healthcare for children deprived of liberty in all settings. We identify important gaps and ambiguities in relation to the current international standards, offer a series of recommendations for civil society, governments, and multilaterals, designed to ensure that all children, including those deprived of their liberty, achieve the ‘highest attainable standard of health.’
